Aaron Smith is a partner in the firm’s Business Litigation Department, and a member of the firm’s Bankruptcy and Financial Institutions practice groups.  Aaron primarily practices in the areas of chapter 11 bankruptcy, corporate restructuring and insolvency matters, creditors’ rights, and commercial litigation.  Aaron has experience representing corporate debtors in chapter 11 proceedings, as well as advising secured lenders, unsecured creditors, bondholders’ committees, and creditors’ committees in the Chapter 11 context. 

Aaron’s litigation experience includes the representation of debtors and creditors in cash collateral disputes, motions to lift the automatic stay, actions to avoid preferential transfers, claims objections, administrative expense applications, fraudulent conveyance lawsuits, and non-dischargeability actions.  He also represents businesses in their acquisition of financially troubled entities, including the acquisition of entities that have filed for bankruptcy relief.  This work includes the negotiation of “stalking horse” agreements, the preparation of auction and bidding procedures, contested sale confirmation hearings, and the assumption and rejection of contracts and leases in connection with bankruptcy sales.
